Terms and Conditions

Short Stay Renting

  1. Key Terms

    1. “Accommodation” – Residential and other properties commercialised by StudentVille.

    2. “Guest” – User who requests a Reservation through the Website or is hosted at a StudentVille Accommodation (“Member”)

    3. “Member” – User who completes the StudentVille Account registration process including, but not limited to, Guests, as described in “Account Registration” below.

    4. “Reservation” – A limited license granted by StudentVille to the Guest to enter and use the specifically pre-agreed upon Accommodation for a duration limited to the dates agreed at the time of the Reservation and its confirmation.

    5. “Services” – Includes the activities of marketing and managing the Accommodation by StudentVille, the facilitation of Reservations and stays in the Accommodation, as well as the sale of additional products or services (“Packs”) to Members.

    6. “StudentVille” - “Student Ville – Alojamento Estudantil Lda” and other associated companies.

    7. “User” – Person who accesses the Website and visualizes its content.

    8.  “Website” – The online platform provided by StudentVille through which Users can access the Services provided. The Website is accessible via the following URL: www.studentville.pt

  2. Modifications

    1. StudentVille reserves the right to, at its sole discretion, modify the Website, Services or these Terms and Conditions at any time and without prior notice. Any modifications will come into effect upon publication of the modified Terms and Conditions, with no further notice being required. Continued access and use of the Website and its Services will constitute implicit acceptance of the Terms and Conditions in effect at any moment in time. Not closing your StudentVille account will be understood as your acceptance of any modifications that may have occurred to the Terms and Conditions.

  3. Eligibility

    1. The Website and respective Services are solely intended for persons who are 18 or older. Access or use of the Website or its Services by persons under 18 is expressly forbidden. By using the Website or Services, the User represents and warrants that he is 18 or older.

  4. Account Registration

    1. Certain content of the Website, such as the reservation of Accommodation, is exclusively accessible by Members. To access this content, the User must register themselves and create an account (“StudentVille Account”) through the Website, which will grant the user Member status.

The Member is responsible for safeguarding their password, which is set upon account registration. The Member agrees that their password is private and confidential and therefore may not be disclosed to or used by any third party.

Unless expressly authorised, in writing, by StudentVille, you are not permitted to share your StudentVille Account with anyone or allow others to access or use your StudentVille Account.

By registering as a Member, you agree that you will take sole responsibility for any activities or actions arising from your StudentVille Account, whether or not you have authorised such activities or actions. The Member will immediately notify StudentVille of any unauthorised use of their StudentVille Account.

 

  1. Reservations and Payments

    1. All Reservations of Accommodation are made through the Website on a secured external server. Reservations are confirmed as of the moment that StudentVille receives payment, in full, from the Guest. The Website uses an external payment system, with encryption of all payment details.

    2. StudentVille does not charge any internal administration fees.

  2. Taxes

    1. As of 1 January 2016, the new Lisbon Tourist City Tax (Taxa Municipal Turística) is in effect. As such, all tourists aged 13 or over must pay a €1 per night tax up to a maximum of 7 nights in a row. This tax is included in the total price.

    2. The applicable VAT rate is included in the total price, and is paid directly by StudentVille.

  3. Cancellation Policy

    1. Reservations may be cancelled up to 30 days prior to the “check-in” date with entitlement to be refunded 80% of the total amount paid, excluding any bank fees. Cancellations made less than 30 days prior to the “check-in” date will be refunded for 50% of the total amount paid, excluding any bank fees. Cancellations made less than 7 days prior to the “check-in” date are not entitled to any refund.

  4. Arrivals/Departures

    1. Guests may “check-in” as of 16:00 on the day of the “check-in”. The Guest will previously receive an access code to the reserved Accommodation, therefore they may arrive at the time of their convenience as of 16:00.

    2. Guests must “check-out” by 11:00 on the day of the “check-out". Failure to "check-out" by this time may subject the Guest of the payment of a 20€ fine. 

  5. Damage to the Accommodation and Fines

    1. The Accommodation is inspected after each stay, and any damage caused will be charged to the Guest.

    2. Guests are obliged to maintain the Accommodation clean and in good condition. Failure to comply with this rule may be subject to fines.

    3. The Portuguese noise emission regulation does not allow loud noise in residential neighbourhoods between 22:00 and 08:00. Guests must comply with these rules, and may be subject to a fine if there are any complaints from neighbours.

  6. Utilities

    1. Heat, water, electricity and internet services are the sole responsibility of the third-party service providers in accordance with their terms of service, regardless whether the cost of these is included in the rent paid.

    2. Tenants must accept the third-party service providers’ terms and conditions for use of their services.

    3. StudentVille is not responsible for any interruptions to these services.

  7. Privacy Policy

    1. The User agrees to StudentVille’s Privacy Policy.

  8. Testimonials

    1. We welcome and encourage members to leave testimonials regarding the accommodation and their experience in the Member’s Area. You understand and agree that your testimonial will be the sole and exclusive property of StudentVille and you hereby irrevocably assign and agree to assign to StudentVille all of your right, title, and interest in the testimonial, including without limitation all moral and intellectual property rights you may have therein and wave any moral rights you may have in the testimonial.

  9. Entire Agreement

    1. Except as they may be supplemented by additional StudentVille policies, guidelines or standards that will be communicated by StudentVille through publication on the Website, these Terms constitute the entire and exclusive understanding between StudentVille and the User in relation to the use of the Website and Services.

  10. Assignment

    1. The User may not assign or transfer these Terms, by operation of law or otherwise, without StudentVille’s prior written consent. Any attempt to assign or transfer these Terms, without such consent, will be null and of no effect. StudentVille may assign or transfer these terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

  11. Applicable Law and Jurisdiction

    1. These Terms and Conditions as well as the provision of Services, are regulated in conformation with Portuguese legislation. StudentVille and the User submit exclusively to the Portuguese jurisdiction. In case of any dispute or claim relating to the interpretation, integration or execution of these Terms and Conditions or the provision of Services, the parties irrevocably submit to the jurisdiction of the competent courts of law in Lisbon, Portugal and their Courts of Appeal.

 

 

Student Accommodation

  1. Key Terms

    1. “Accommodation” – Residential and other properties commercialised by StudentVille.

    2. “Guest” – User who requests a Reservation through the Website or is hosted at a StudentVille Accommodation (“Member”)

    3. “Member” – User who completes the StudentVille Account registration process including, but not limited to, Guests, as described in “Account Registration” below.

    4. “Member’s Area” – The section of the Website that is only available to Members and can be accessed by these by “logging-in” to their StudentVille Accounts.

    5. “Reservation” – An agreement in principle between StudentVille and the Guest so that the Guest can have access to and use a specifically pre-agreed upon Accommodation for a duration limited to the dates agreed at the time of the Reservation and its confirmation. A rental contract will only exist after a Tenancy Agreement, better described in “Tenancy Agreement” below, is signed by the Guest.

    6. “Services” – Includes the activities of marketing and managing the Accommodation by StudentVille, the facilitation of Reservations and stays in the Accommodation, as well as the sale of additional products and/or services (“Packs”) to Members.

    7. “StudentVille” - “Student Ville – Alojamento Estudantil Lda” and other associated companies.

    8. “User” – Person who accesses the Website and visualizes its content.

    9.  “Website” – The online platform provided by StudentVille through which Users can access the Services provided. The Website is accessible via the following URL: www.studentville.pt

  1. Reservations and Payments

    1. All Reservations of Accommodation are made through the Website on a secured external server. Reservations are confirmed as of the moment that StudentVille receives payment, in full, from the Guest, verifies the proof of enrolment in an institution of higher education submitted by them, and the Reservation appears as “Confirmed” in the Member’s Area. The Website uses an external payment system, with encryption of all payment details.

    2. Alternatively, payments may be effected by method of bank transfer, accompanied by the Reservation reference number, available in the “Reservations History” section in the Member’s Area of the Website or in the confirmation email sent by StudentVille.

    3. StudentVille does not charge any internal administration fees.

    4. StudentVille charges a deposit which is refundable to the Guest after their stay in accord with the Tenancy Agreement. If there are is any damage caused by the Guest and/or any fines applied, these will be deducted from the from the amount of the refundable deposit, in accord with the Tenancy Agreement.

  2. Taxes

    1. The applicable VAT rate is included in the total price, and is paid directly by StudentVille.

  3. Cancellation Policy

    1. Reservations may be cancelled up to 30 days prior to the “check-in” date with entitlement to be refunded 80% of the total amount paid, excluding the deposit and any bank fees. Cancellations made less than 30 days prior to the “check-in” date will be refunded for 50% of the total amount paid, excluding the deposit and any bank fees. Cancellations made less than 7 days prior to the “check-in” date are not entitled to any refund.

  4. Arrivals/Departures

    1. Guests may “check-in” between 09:00 and 17:00 on the day of the “check-in”, unless other arrangements have been specifically pre-agreed upon in writing between the Guest and StudentVille.

    2. Guests must “check-out” by 11:00 on the day of the “check-out”. Failure to “check-out” by this time may subject the Guest to the payment of a €20 fine.

  5. Tenancy Agreement

    1.  The terms of the “Tenancy Agreement” are defined in the agreement itself which will be supplied by StudentVille to the Guest, who will have to sign it to validate it before any access is granted to the Accommodation.

  6. Utilities

    1. Heat, water, electricity and internet services are the sole responsibility of the third-party service providers in accordance with their terms of service, regardless whether the cost of these is included in the rent paid.

    2. Tenants must accept the third-party service providers’ terms and conditions for use of their services.

    3. StudentVille is not responsible for any interruptions to these services.

 

  1. Privacy Policy

    1. The User agrees to StudentVille’s Privacy Policy.

  2. Testimonials

    1. We welcome and encourage members to leave testimonials regarding the accommodation and their experience in the Member’s Area. You understand and agree that your testimonial will be the sole and exclusive property of StudentVille and you hereby irrevocably assign and agree to assign to StudentVille all of your right, title, and interest in the testimonial, including without limitation all moral and intellectual property rights you may have therein and wave any moral rights you may have in the testimonial.

  3. Entire Agreement

    1. Except as they may be supplemented by additional StudentVille policies, guidelines or standards that will be communicated by StudentVille through publication on the Website, these Terms constitute the entire and exclusive understanding between StudentVille and the User in relation to the use of the Website and Services.

    2. Once the Tenancy Agreement has been signed, it takes precedence over these Terms and any other additional policies, guidelines or standards.

  4. Assignment

    1. The User may not assign or transfer these Terms, by operation of law or otherwise, without StudentVille’s prior written consent. Any attempt to assign or transfer these Terms, without such consent, will be null and of no effect. StudentVille may assign or transfer these terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

  5. Applicable Law and Jurisdiction

    1. These Terms and Conditions as well as the provision of Services, are regulated in conformation with Portuguese legislation. StudentVille and the User submit exclusively to the Portuguese jurisdiction. In case of any dispute or claim relating to the interpretation, integration or execution of these Terms and Conditions or the provision of Services, the parties irrevocably submit to the jurisdiction of the competent courts of law in Lisbon, Portugal and their Courts of Appeal.
